Debt Recovery and Insolvency
LALIVE has extensive experience in representing creditors of companies in financial difficulty, both before and after the commencement of insolvency or re-organization proceedings. The firm also assists companies in negotiating and drafting judicial or extra-judicial arrangements designed to avoid insolvency proceedings, and represents such companies directly in insolvency proceedings. The firm is particularly active in the context of international insolvency and routinely provides overall strategic advice to clients while coordinating the work of local lawyers in multiple jurisdictions where the insolvent or near-insolvent company has assets and/or operates.
Representative assignments:
- Representing a Western European country in the insolvency of a very large Swiss company in the transport industry
- Representing an American bank in the insolvency of an international company based in Geneva with several subsidiaries in Africa, including by syndicating a number of major creditors with a view to crystallising a minority veto power and obtaining appropriate decisions from the liquidator
- Advising a Swiss company with debts totalling over CHF 500 million and conducting successful negotiations with its main creditors for the extra-judicial settlement of their claims
